In Alabama you have to take any vehicle not previously regestered in the state to the DMV for them to inspect it before you can get a tag. I was on my way to the DMV - FIVE blocks away - when I got a ticket for "expired tag".
So I go to court. First, I was the LAST to be called. In fact the judge did not even call me, he asked if there was anybody else that had not been called, & I raised my hand. This was after he had cleared ALL the people who were pleading guilty, the convicts in shackles, then the folks pleading not guilty (whom best I could tell all had to pay a fine anyway!). When I raised my hand he asked me to come up, & asked my name. He found the paperwork, & asked me why I was there. I told him "The Fort Payne police department does not know the state law.".
Me: (handing copies to the judge) "Here is a copy of the Ohio title and the bill of sale I presented to the officer. And here is a printout of the Alabama DMV website..."
Judge: (interupting me) " I don't want to see no goddamn website!"
Me: (pointing to hi-lighted text on the page) "But it's the Alabama Department of Motor Vehicles website showing that I'm required to take the car to them for inspection before they'll issue a tag."
Judge: (not even looking) "I don't care." "Do you have the registration?"
Me: "Yes here is the tag receipt & title application dated the same day."
Judge: (looking at the bill of sale) How long had you owned the vehilce?"
Me: Well when I bought it, it was in Ohio, and it took about 6 weeks before I took delivery..."
Judge: (interupting me again) Well you have 30 days to get a tag so you're guilty!"
Me: "How am I supposed to take a vehicle to the DMV to get it inspected when I don't even have it yet?"
Judge: "That is not my problem!"
So once again (FOR THE THIRD ****ING TIME!) I've been DENIED DUE PROCESS!!! Not allowed to present my case/evidence, & had to PAY A ****ING FINE when I was COMPLETELY following the law!!!
And cops wonder why they get shot when they pull someone over. If the next cop that pulls me over has no legal reason, and/or gives me any **** , I'll show them EXACTLY how I feel too!!!!

I can be really tough sometime's when you live in an area of enforcement (revenue!)

I agreed with everything else but that was out of hand don't you think? What if someone shot at you for doing your job? Your just having a bad day huh? Drink a beer and roll with the punches!

You were allowed to present your case. You obviously weren't following the law if things were expired.

Its pretty disgusting that you think because you didn't do something right its the reason why cops get shot when they pull people like you over who obviously are breaking a law. You show them how you feel tough guy. I'm sure you will piss and moan like a little girl then too when they arrest you for disorderly conduct saying you didn't break any law.

No one is screwing you over but your self.

I was NOT allowed to present the EVIDENCE that the STATE required me to take the car to the DMV for inspection BEFORE they will issue a tag!!!
HOW THE **** am I supposed to get the tag ON THE CAR I JUST BOUGHT BEFORE going to the DMV to get it inspected, WHEN THE STATE LAW REQUIRES ME TO TAKE IT TO THEM FOR INSPECTION IN ORDER TO GET A TAG!!!???!!!

You could have used a tow truck but instead you didn't and broke a law. Its your own fault. The judge saw it. I'm the dumb one but you broke a law and aren't man enough to admit it so you blame every one else for when you screw your self.

You are such a tough guy aren't you? Bragging about how you are going down shooting? Instead of taking down innocent people because you have screwed your self in life just take your self out. Just because you screw your self doesn't mean you have to screw other peoples lives. Yeah you are a real hard dude.

This is the part where you start talking about how little you have. Its an American tradition to live beyond our means. Can't you afford a tow truck 5 blocks?? Appeals can be free if you can prove a hardship, right?

Here's a thought - don't be a jackass to the judge, even if you think you're right. Telling the judge the police don't know the law immediately told him you were a punk and he would look for any reason possible to put the screws to you. If you'd simply explained the officer ticketed you for no tags, but you were acting to your best knowledge how you needed to proceed according to the law you ready on the website. It might not have mattered, but taking an attitude as soon as you open your mouth will remove any slack the judge might have been willing to give you.

If you can't control your temper in court - hire a lawyer to do the talking for you.

I don't know about your state, but California DMV will issue a 30 day temporary registration tag so that we can take care of things such as smog tests and inspections at the DMV. It can be extended if you ask nicely.

A lot of people are not aware of that service but as any cop will tell you, ignorance of the law is no defense.

I do feel for you though. That judge was having a long and bad day and it looks like he took it out on you. If your judges are elected like ours are, then the best thing you can do is vote that SOB out of office. Get his name and create fliers and put them all over your town the next time he is up for re-election.

It gets to 92+ degrees in here in the afternoon with the little AC running 24/7. I don't have a well, so I have to catch rain water off of the roof to take showers. I can't work full time because of back & knee problems (mostly - but there's a lot more pain involved too), from doing body & frame work for 35+ years. I work as much as I can &, even though I don't have any house payments, it's a real struggle just to make it through each day.
Yeah I'm living WAY beyond my means!!!
I've been DENIED DUE PROCESS in court THREE times now! Do they think I can take much more??? Do I have very much to loose? It's depressing enough to have lost 15 years of my life (including the 300 CDs that I had collected!) to ****ing THEIVES - & not have the ****ing COPS do a DAMN thing; but then to have to live like this & on top of all that put up with those GREEDY BASTARD'S **** too? I really am on the very edge...
I'll change my attitude when they start doing their job, & quit breakling the law themselves (like that's ever gonna' happen!).

Well the car was 200 miles away. Have ANY idea how much a tow truck would cost for that?
No, appeals are never free. You have to spend the time, & if you want different results then you have to hire a lawyer. Then, in this corrupt city/state/country, you'll STILL be found guilty & have to pay the fine ANYWAY in ADDITION to the lawyer's fees.
There's NO WAY a poor man can get justice!

I would have taken the Ohio tags off to drive it to the dmv since Alabama doesn't issue temp tags for new/used car purchase. no tags seem to be less hassel than expired tags from years ago. They removed the expired virginia tags from my fiero before I took it home from the fiero factory and then to the dmv in huntsville the next day. But sounds like the judge was having a bad day and taking ito out on anyone cause he could.

There was no temper involved. I spoke calm & collected all the way up the point where I asked how I was supposed to get the vehicle inspected when I don't even have it yet - & then only barely raised my voice.
I was presenting facts. Isn't that what you're SUPPOSED to do in court??? Don't assume I was a jackass when I wasn't!

I had taken off the Ohio tags, & put on the tag from the last car I sold over a year ago. In Alabama, you keep the tag when you sell ta car & put it on the next vehicle you buy. Once again: I was doing EVERYTHING strictly BY THE LAW!

There are no temporay tags issued. You buy a car from out of state, & you have to take it to the DMV for inspection before they'll issue a tag.
Actually the judge was having a great day. He made everyone pay a fine, & that probably netted him about $20,000 for the day's work. He was in a good mood. Just a greedy bastard ***hole .
I'm not going to worry about that. I'll be moving permanately out of Alabama - the state & particuliarly Ft. Payne will never see another dollar of my money. This after I've been trying to pump all that I could into that economy since before I bought my property there in '89.

I have one question. If you were to go to the DMV with proof of insurance, and request a temporary (usually 10-30 days) tag, would they give you one?

If so, then you have no excuse. If not, I'd be as steamed as you are.

So, you had 30 days from the day of purchase, not the day of delivery. Face it, you were guilty. It's not the DMV's fault or the cops fault that it took you longer than 30 days to receive the car. Just pay the fine and learn your lesson.

Re-read the original post. I don't think a single person got out of there without paying a fine. Court is a REAL cash cow for these CORRUPT city (& county) governments!

So: what would you have done? Just not tagged the car & therefore never driven it? Let it sit for a number of months or years untill you decided to sell it?
Edit: STATE LAW IS STATE LAW! Local jusidictions are not allowed BY LAW to give out tickets when you are in compliance with STATE LAW. Of course, they don't CARE about the LAW & in fact think they ARE the law!

I had on my best shirt & my best jeans. The shirt is about a $40 - $50 shirt that I picked up at the local thrift shop (very nice!), & I don't OWN anything but jeans! Other than a couple lawyers, I was the best dressed person there.

You could have called the DMV and asked what to do in your situation. As suggested before, you could have towed it there.

Yeah, well I don't heve the money for a 400 mile tow bill. Nothing in the state law says you have to TOW the vehicle to the DMV.

But you are right. I reread everything and it's not your fault at all. Its every ones fault but yours. Its the states legislative session who made the laws. Its the cops fault for enforcing the law. i agree, working in the auto biz and dealing with shops, its funny how many times a shop tells me the customer failed inspections after geting a car towed in, dont wana pay for the work, and try and drive the car home... most let the police know before they even get off the lot, driving an unsafe, untaged, and probaly un-insured car home.

i get that you was trying to get to the shop, but everystate i know will issue a temp tage, be it 10, 15 or 30days, or you can tow, push(it was only 5blocks right?) or ask the shop if they have a transporter/dealer/inspection tag, after all, i belive roadtest is part of the standard inspection, maybe you coulda made a deal with them where they woulda picked it up being only 5blocks away...

I think here you can schedule to have county sheriff come and inspect the car on your property.

Few people do and just drive it there, and I've not heard heard of anyone getting a ticket on the way to the BMV with papers in hand, but technically, it can happen.

Jesus Christ! Get it STRAIGHT: I WAS TAKING THE CAR TO THE DMV TO GET IT INSPECTED & GET THE TITLE TRANFERED & GET THE TAG!!! Iwas 5 blocks away WHEN I GOT THE TICKET - NOT from where I store my cars. There was NO SHOP INVOLVED! They inspect it AT THE DMV.

Ok, I understand your predicament now. No one in Alabama can have a car. That must be it. No one has ever been able to buy and register a car because you have to have tags to drive it and you can't drive it to the DMV without tags.

That must be why I see so many people on horseback on the boulevard in Montgomery.
