Looks like we may have a case of a common dolphin (Delphinus delphis)) trying to pass herself off as a harbor porpoise (Phocoena phocoena).

"For the first time, wild dolphin observed 'talking' with harbor porpoises"

A wild dolphin named Kylie may be able to “converse” with porpoises, a striking example of cross-species communication.

Is that a constitutionally protected freedom?

The dolphin is an outlier, because she has not been seen in the company of other dolphins of her same species in at least the last 14 years.
