Some thoughts... the U.S. Constitution has something called the Supremacy Clause, which means that Federal law will trump state law when there is a conflict in decision. Life, Liberty, and the Pursuit of happiness is mentioned in the Declaration of Independence, but the assumption was always that your rights are guaranteed from interference from the Government. I would have to determine if there are any laws at the Federal level that guarantee life... and that it isn't just an assumption.
If there is a Federal law that makes it illegal to kill someone, then this California law would be in violation and unconstitutional.
On just a whim, once a child is BORN, there is no question in anyone's mind that this child is a sentient human being. Being murdered is clearly a violation of basically all your rights... so I would have to assume that this law is unconstitutional. I think it's done to protect partial-birth abortions, which I consider to be hideously barbaric... I can't imagine any doctor that would be willing to do this. But it's definitely opening the door to far worse since a mother could kill her child several days after birth and it be like... too bad, so sad.
