If you are afraid of getting busted employing a prostitute just film it. It is legal to pay an actress to perform in a porno movie.

I've never elicited the services of a prostitute, but obviously there's more to it than that.
In some states, merely agreeing to using services of a prostitute, without literally any exchange of money, is illegal. So while I think what you say has merit, I think you'd have to be really clear...
Prostitute: "Hey good lookin', you ready for a good time?"
Customer: "No, actually I am not. I am a film producer for FredToast Erotica. Are you interested in starring in a movie?"
Prostitute: "Uuuh... suuure?"
Customer: "Excellent, you'll need to fill out these forms, including a W2, a health form, and your agreement to having your likeness on television."
Pimp: "Mutha f**ker, if you don't move yo ass in the next 10 seconds, I'm going to kill you."
Customer: "Thank you sir, I apologize..."
