Jack Smith lacks any constitutional authority to petition SCOTUS let alone even prosecute anyone. He is not an officer under the Constitution. He has not met the Constitutional requirements of appoints by the President and approval by the Senate. He is at best a federal employee. SCOTUS can rule he lacks authority to do anything. By doing so they end all of prosecutions and dodge the harder and more political questions.
