No ‘Backbone’: DeSantis, Fellow Conservatives Hit Kavanaugh For Siding With Liberals On Health Care Vax Mandate
Florida Gov. Ron DeSantis (R) knocked Supreme Court Justices Brett Kavanaugh and John Roberts for siding with the liberal justices to allow a vaccine mandate for medical facilities that take Medicare or Medicaid payments.

“On the nurse mandate and the doctor mandate, Roberts and Kavanaugh joined with the liberals to allow the nurse mandate,” DeSantis said on the “Ruthless” podcast, The Daily Wire reported.

“So here’s what’s going on, think about how insane this is,” he continued. “Now, in Florida, we protected the nurses, so we have people that are working. But in other states, they fired nurses who were not vaccinated.”

The governor continued, noting that some liberal states could have COVID-positive employees working in hospitals who are vaccinated, “meanwhile the unvaccinated, likely immune through prior infection, healthy nurses are on the sidelines fired. How insane are these policies?”

“But honestly, Roberts and Kavanaugh did not have a backbone on that decision,” DeSantis emphasized. “That’s just the bottom line.”

Though Kavanaugh sided with the liberals on the health care mandate, he joined the conservatives to successfully block a Biden administration mandate that would have forced private businesses with at least 100 employees to require workers to be vaccinated against COVID-19 or submit to regular testing.

“OSHA’s COVID–19 Vaccination and Testing; Emergency Temporary Standard, 86 Fed. Reg. 61402, is stayed pending disposition of the applicants’ petitions for review in the United States Court of Appeals for the Sixth Circuit and disposition of the applicants’ petitions for writs of certiorari, if such writs are timely sought,” the court decided. “Should the petitions for writs of certiorari be denied, this order shall terminate automatically. In the event the petitions for writs of certiorari are granted, the order shall terminate upon the sending down of the judgment of this Court.”

Fox News host Tucker Carlson was unsatisfied with Kavanaugh, too, calling the justice a “cringing little liberal” during this Thursday evening show.

Speaking about the ruling with attorney Harmeet Dhillon, who helped represent The Daily Wire in the fight against the Biden administration, Carlson chimed in, “With no help from Brett Kavanaugh, I notice. Cringing little liberal.”

Conservatives voiced frustration with Kavanaugh on social media, too.

“I despise Brett Kavanaugh. We should have left him for the wolves. Freaking loser,” radio host Jesse Kelly commented.

“America First patriots and [President] Trump rallied fiercely to Brett Kavanaugh at his crucible moment, and he’s been a disappointment ever since,” Steve Cortes said.

“It was disappointing to see Chief Justice John Roberts and Justice Brett Kavanaugh join the Court’s liberals to uphold a mandate that targets health care workers,” Rep. Matt Gaetz (R-FL) posted. “America’s businesses should forget these mandates faster than Joe Biden forgets his daily schedule.”

Phil Kerpen questioned how the justice could come to his decision. “How in the world did Roberts and Kavanaugh disagree with this? Baffling,” he wrote.

Seems like Roberts likes to keep decisions close for some reason? As if he is saying the Court is not conservative or liberal. Rather than just dealing with the facts.

He and Kavanaugh voted with the Obama appointees because they aren't conservatives.

Both the OSHA and Health Care Workers cases were decided the way I thought they would be. That doesn't necessarily please me but, the cases were decided on and for different reasons. The President doesn't have the authority to make the OSHA decision/mandate but, the President and HSA may have the authority to dictate how health care dollars are spent to care for health care recipients. It may be a fine line but, a line it is. Basically, SCOTUS kicked further decisions back down to lower courts. This isn't over yet.
There is still a lot to be considered and decided.
