Not sure what the court was thinking here, but depending on the specific activity, I suppose it could be covered under either.

This is one of the most ridiculous thing I've ever seen. This is a strong case for tort reform.
I didn't see anywhere that it suggested it, is GEICO going to appeal this?

The claim got denied y the insurer. Appeal to the claim automatically goes to Binding Arbitration. Which is usually used to screw the insured.
For some reason, the Arbitrator decided to screw the company for once. Good for him. I hope this was his last case before retiring, because he won't be getting called any more.
