Emc209i Is there something you want to get off your chest?? I never once threatened with a Lawyer. Your attacks are ridiculous and have no bearing on my question as you see in the threads title EBay Scammer??????? Question marks at the end. Talk about not understanding and personal attacks..
Watch those red marks as there climbing son and your bitching about here on RTF should stay there. RIck

Title- "Ebay scammer?? You be the Judge"
Shooting straight and true. That's what one would tell you after a good laugh. Also, ask Borecky about the rating system here for me, ok. Or are you Rick Borecky? Seems I sent you a pm about that back in 06, suspicious that you joined simultaneous to his banning.

By the way Rick- I can read English...
"Best for you to refund or not email me anymore. As you have been a great witness " <-- implying that --> Eric **** (a Lawyer) and Ken **** (another Lawyer), who "agree I(you) am(are) correct.", are behind you on this ordeal, and you intend to take this situation to where a self incrimination might be a necessary tool.
"Watch those red marks as there climbing son and your bitching about here on RTF should stay there."- Don't ever tell me what to do.

Not a threat in anyway , they agreed with the facts at hand and not start a case.. I stated above{{{{ Now I have to go thru EBay, Pay Pal and my credit card company just to get this corrected}}}}} Maybe a good read of everything { without assuming as I was told I wasnt allowed } again slowly and you will see I didnt threaten any lawsuit. That is funny and you have not helped in the thread at all. You left here after a nervous break down practically, came back sling snot at folks, went to RFT and slammed folks and this place here, and now going back at it again. You wonder why you get so upset over the Fiero collecting. I just thought you more of a man to just answer the question and not toss vengeance in it with every other word.
{{Don't ever tell me what to do.}} that is funny and I almost fell out of my chair. Thanks for the comic relieve and can we get back on track now.
At this point it is in Pay Pals hands and they will make a desicion to which I will follow. Thanks everyone for the responses even if I had hoped for a differnt outcome. Everyone was pretty civil except one who has acted the same in the past and left here for awhile blaming us for his problems. Its archived. Thanks,,Rick

Although he did not go into detail about it being a reproduction, (I would have at least mentioned it if I was the seller.) He also does not say it was OEM or NOS either. From my viewpoint I don't think you were "scammed" because it was not intentionally misrepresented. If the ad claimed OEM or NOS then he would be scamming people because he knew it was not. Instead he just listed a basic ad stating he was selling a steering wheel for a Fiero GT. Personally I feel if you are selling something on Ebay you should give a very detailed ad, but if the ad lacks details then I would have asked questions prior to bidding.
Anyhow, The above is just my opinion. |

I agree with the above. Both parties could've use some more-detailed info... but the seller is certainly not at-fault for doing anything (intentionally) wrong.
As to you (Rick) "threatening" with lawyers... yeah - I think pretty much any normal person read your statement that way.
Personally - if you had approached the problem with some humble respect (for realizing that you failed to ask the important questions first), I would've consider refunding the cost (less fees & shipping) upon return of the product. BUT, you immediately took an uninformed & accusatory tone... and as such, I don't think I'd be quite so inclined to deal with you either.
At this point in the "discussion" - I would say that IF you made a full & honest public apology... then I'd consider working something out, otherwise it seems that the crowd here (and I'm sure eBay & PayPal) would find in favor of the seller.
BTW - I did purchased used tires off ebay... and they've been problem free!
<good luck with dispute resolution... I've been through that (on a 2000 Corvette Deal) and won!>

The seller felt threatened, he states so in his post, which was your intention for mailing him that you had consulted with your pals. "Look man I'm not trying to start a war with you."
Your second message forward was nothing but aggression. The fact that you decided to settle with your cardholder etc has nothing to do with the pretense. You didn't get what you wanted so you decided to coax it out of him by trashing him here. You are wrong Rick regardless of what my personal history is. Not doing your research, or ensuring the quality of the sale.. the fault was yours, you can't come onto a forum and act like he scammed you and expect sympathy from me.
You wanted to know why I attacked you- thanks for laying it out so clearly in the last post- I will continue to do so also. My intention was never to help you burn an ebay seller, it was to call you out. I have gone out of my way to help 100's of people on this forum: mechanical, electronic, photoshopping, and sending free parts around, many before you signed up. Then you try to walk over me like I'm going to take it. WRONG.
There were two who were not civil in this case, me and you.

Looking at the description, this is an '84 so the steering wheel I posted for sale (still, who knows) would be the proper one to go with if looking to go all original.

I think your missing the progressive emailing. This was over time and I think your reading it as if I made the last emails first. I professed my problem in the first two emails with ZERO luck. You act as if I went at him right away and that is not true..
I guess I am looking at it from my ethics and would have given a refund to any unhappy customer if I mistakenly sold a Remanufactured part and dint list this.. I have never told someone they read it wrong and I am not entitled to give you a refund. I would never leave out a restoration fact PERIOD.
By the way it was a buy it now and I didn't want to loose the chance at it. I trusted his description and have seen many brand new parts on Ebay surface so to say there are no OEM part showing up is wrong. There are 3 Ebay sellers who sell only new OEM stuff constantly. Rick
