Attention all,
You will not get your parts or money back from Tommy.

I'm sure by now who ever has paid him, the money is spent. If you do a search under his name I'm pretty sure 90% of the posts he has made are about either parting out of selling this car.

If a person fails to deliver as promised, could threads like this be forwarded to the local police/sheriff dept. to be used as evidence and the buyers press charges of theft against the seller?

"California has a set of laws aimed specifically at Web merchants. Anyone selling (or attempting to sell) to a California citizen through the Web must comply with specific statutes intended to reduce the incidence of fraud. Not only must online merchants adhere to the same laws that a merchant in the real world must follow, but they must also comply with additional requirements. The first is that before any product can be sold, the vendor must state the legal name of the business, the full text of the vendor's return and refund policy and the street address where they conduct business. 4 A post office box may be used if certain other requirements are met. The disclosure may be made either on the website or via email.



If the disclosure is done on the webpage, then it must be in one of four places:
1. The first screen displayed when the site is accessed;
2. The screen where the goods are first offered;
3. The screen where an order is placed for the goods; or
4. The screen where the buyer enters payment.

The required information cannot be smaller or less legible than the offer of goods or services. The merchant must also state a method for the buyer to receive this information by email. The email disclosure must be made within five days of request. Webpages that advertise a toll-free phone number may implicate telemarketing laws depending on the individual state and its laws.

Failure to comply with these requirements can subject a vendor to a misdemeanor conviction in California5 and either six months in jail or a fine up to $1,000. California requires that all websites aimed at California consumers adhere to the requirements. As a result, some attorneys advise that all websites selling goods comply no matter where the vendor is located.6 Another way to avoid the law would be to include a disclaimer on the website stating that no sales will be made to citizens of California."

I reported my $37 M/O stolen---Dont know what happens next--
I'll contact FBI Tuesday to add my name to the list of 'victims'

What sucks is that unless its in the thousands of dollars-and if Toms got a good lawyer, he wont serve any time just a small fine. I may have to make a trip up to NY.

Tom you should have put out a PO Box w/ false name if your where gonna rob and actually get away w/ it.
Maybe 8600 Brewerton is an abandoned house...if it is, congrats-youd make a fine Politician

I came too close to buying from this guy. This has happened to me before but I think my voice over the phone made me sound older and bigger (that gets annoying sometimes)

Yup, was a friend for 16 years too. I think I'd like to get a list together of who he owes & how much. I'm sure I could maybe... talk to his mom or uncle who I know still would talk to me and they could maybe talk some kind of sense into him?

Well i was giving him the benefit of the doubt... but i guess it wasnt a good idea. He screwed me out of about 60 bucks for a guage pod. sent him a PM last week and got no response. decided if he didnt respond by today i would let you know. It sucks that you cant trust people on here.

I am pretty sure tommy has no parts for a fiero. I did not see this thread until about 5 minutes ago as I am not on here much. I purchased tommys car from him. It was a 87 duke 5 spd. Tommy has no idea what he is doing on a car. The wiring was hacked up and when he sprayed primer on the car he didnt take anything off and oversprayed on the windows and mirrors. I just figured i would let everybody know that he did try and sort of back out of the deal we had. He tried telling me that after i got there he didnt have the wheels he said he did and the car was not close to the condition he said it was in. He sounds like a big guy on the phone but he isnt. If anybody wants to know where he is located I could help ya out. i hope everybody can get their money back from this kid cuz he isnt a good person to deal with and I did not know he owed people these parts or I never would have bought the car.

Just got off the phone with Tommy. He says that he's still in Indiana near Waterloo, working there. That's where he was when I called at the end of May. At that time he told me he'd be back in NY in 13 days.
Says he'll be back in NY before school starts.
