You can read the spin from your favorite story tellers, or go straight to the source: https://www.fisc.uscourts.g...19%2002%20191217.pdf

This order responds to reports that personnel of the Federal Bureau of Investigation (FBI) provided false information to the National Security Division (NSD) of the Department of Justice, and withheld material information from NSD which was detrimental to the FBI's case, in connection with four applications to the Foreign Intelligence Surveillance Court (FISC) for authority to conduct electronic surveillance of a U.S. citizen named Carter W. Page. 1 When FBI personnel mislead NSD in the ways described above, they equally mislead the FISC.

In order to appreciate the seriousness of that misconduct and its implications, it is useful to understand certain procedural and substantive requirements that apply to the government's conduct of electronic surveillance for foreign intelligence purposes. Title I of the Foreign Intelligence Surveillance Act (FISA), codified as amended at 50 U.S.C. §§ 1801-1813, governs such electronic surveillance. It requires the government to apply for and receive an order from the FISC approving a proposed electronic surveillance. When deciding whether to grant such an application, a FISC judge must determine, among other things, whether it provides probable cause to believe that the proposed surveillance target is a "foreign power" or an "agent of a foreign power." See§ 1805(a)(2)(A). Those terms are defined by FISA. See § 1801(a)-(b). A fi nding of probable cause to believe that a U.S. citizen (or other "United States person" as defined at Section 1803(i)) is an agent of a foreign power cannot be solely based on activities protected by the First Amendment. See § 1805(a)(2)(A).

To bastardize an old adage: Trump is up to his ass in alligators, but has not lost sight of his original objective.

The world's premiere law enforcement agency has been subverted. No one is safe.

Many of us knew this, but far too many others refused to accept reality.

Hopefully, this is one step on a long journey of redemption.

I think, Trump knows what he is doing, he knows he could not drain the swamp in 4 years or even in 8, but If he was able to show, or have the dems and "r's" show the American people, just how deep the swamp is, the we the people might just, want to help drain it. even after he has left public life.
He is being , allowing himself to be a martar to get the swamps actions into the public light.
And the dems and r's (rinos) and media are playing his chess game just like a fiddle.
Yes, yes, the art of the deal.

The year is 2019 and I posted the verification eight days ago in this thread: https://www.fiero.nl/forum/Forum6/HTML/124395.html

The document that I posted at the top of this thread is the initial action taken by the court, which gives the FBI 24 days to produce a plan to clean up their act.

This is not speculation or opinion. This is straight from the USDOJ.

What it means is that the FBI conspired to overthrow the government. It's really pretty simple and many of us were warning y'all about it.

Now, we await Durham's moves.

Of course, Trump tweets too much and once said "pussy" to someone who was taping him without his knowledge; which is so much worse.

The FBI has been politically dictating through fear ever since Hoover saw commies under every rock and tree stump in existence.

They exist to enforce a political agenda. Primarily on the USA but they reach over the entire globe. They can Always find an excuse to be wherever they want to further that agenda.

J.E.Hoover overstepped his bounds. CoIntelPro targeted not only Communists but groups such as the Weathermen, the KKK and the Black Panthers. Although it doesn't excuse the actions of the FBI, these were all terrorist groups.

The FBI exists to investigate crimes which threaten our national security. An investigation should not be initiated until a crime has been identified.

Under Obama, the FBI and the IRS were subverted to target political foes. That is one of the most egregious abuses of power ever undertaken by a president.

Very True. I have been warning others for over a year and got nothing but ridicule from the Dems and Libs. Now, we will see for sure what this country is made of and whether our Constitution and our System of Justice can withstand this abuse of Power by those who have done everything that they can to overturn the will of the PEOPLE.

I would like to think that some might benefit from a review of these threads from July 2016. However, those who would benefit most will likely be in denial to the bitter end.

Another small step for John Durham and (hopefully) a giant leap for the American people:

BREAKING: Durham Criminal Investigation Zeros In On Brennan, Communications With Comey

quote
United States Attorney John Durham’s criminal investigation into the origins of the FBI’s Russia investigation is reportedly taking a close look at former CIA Director John Brennan.

Durham has “requested Mr. Brennan’s emails, call logs and other documents from the C.I.A., according to a person briefed on his inquiry,” The New York Times reported. “He wants to learn what Mr. Brennan told other officials, including the former F.B.I. director James B. Comey, about his and the C.I.A.’s views of a notorious dossier of assertions about Russia and Trump associates.”

And this opinion piece, because the title is too good not to repeat:

The Blues at St. James Comey’s Infirmary

quote
When your best explanation for humiliating failures is that you were incompetent, not criminal, you are in trouble.

Look out! Here comes the truth, better cover your eyes.

My initial post in this thread linked to a document from the FISC which made several demands of the FBI. The last paragraph of that document demanded the release of an order from December 5, 2019. Here is that order: https://www.fisc.uscourts.g...20Order%20191220.pdf

The order outlines the failure of the FBI to provide information requested by the court and as a result, made the following demands:

quote

It is further ORDERED that by written submission on or before December 20, 2019, the
United States shall:

(1) Identify all other matters currently or previously before this Court that involved
the participation of the FBI OGC attorney whose conduct was described in the
Preliminary Letter and Supplement Letter;

(2) Describe any steps taken or to be taken by the Department of Justice or FBI to
verify that the United States' submissions in those matters completely and fully
described the material facts and circumstances; and

(3) Advise whether the conduct of the FBI OGC attorney bas been referred to the I
appropriate bar association(s) for investigation or possible disciplinary action.

I find the third demand most interesting.

It seems that things are finally starting to move. We shall see.

Some have questioned the resolve of the FISC, in light of the fact that they allowed all of this to happen. There is a lot of finger pointing going on in the USDOJ right now.

Here is an opinion piece regarding the judge who produced the above referenced orders: https://pjmedia.com/trendin...o-sit-on-your-hands/

quote
"I want to admonish this judge," Levin said. "She had an opportunity to act when it mattered. Back on April 20, 2017, the Landmark Legal Foundation under its president, Pete Hutchison, filed a motion -- a secret motion -- with this court. And it was a motion informing the judge of the violations that had occurred based on published reports because it was known back in April of 2017. Some of it, if not much of it. And those exhibits were provided to the judge. Five days after we filed that [...], the judge ruled" to deny the request arguing there was "no matter pending before the court with respect to which such an appearance would be proper."

"That was always a disingenuous reply," Levin went on to say, "but this judge, and apparently she changed her mind today. Apparently she changed her mind more than 2.5 years later and realized: 'Oh, I have jurisdiction. The matter is pending I suppose.' Although that never made any sense because a judge is free, even when a matter is done, to call parties before them in their courtroom if in fact the judge believes wrongs have been committed in the court and against the court."

The FISA court is not without problems either. They were told about this abuse of the FISA system over a year ago by the Nunes report out of the Senate. But, they pointedly chose to ignore that report. I am at the point where I don't believe that we can keep the FISA court and still maintain our liberties acknowledge in our Constitution. FISA court is an aberration in American jurisprudence and is counter to many of our rights outlined in the Bill of Rights. The politicians thought that they could contain it and prevent abuse of the court, but we see now that the more power we give them the more that they abuse the power. Kill FISA now.

Nothing new about that.
There is not a local, county, state or federal govt agency or department that doesn't/hasn't grabbed more power than they were directed to at their outset.
It's the duty of The People to rein them in and keep them in check.

I totally agree with you that the People need to rein them in and keep them in check.

Here is a little video of Rudy talking about the Ukraine corruption and how Hunter and Joe Biden are intimately involved.

“The flak only gets heavy when you’re over the target.”

That is an adage from WWII.

Well it looks like the left is ramping up their rhetoric in a campaign to besmirch the reputation of the heretofore universally lauded John Durham.

Here is Durham's statement on which all of the criticism is based: https://www.justice.gov/usa...torney-john-h-durham

quote
“I have the utmost respect for the mission of the Office of Inspector General and the comprehensive work that went into the report prepared by Mr. Horowitz and his staff. However, our investigation is not limited to developing information from within component parts of the Justice Department. Our investigation has included developing information from other persons and entities, both in the U.S. and outside of the U.S. Based on the evidence collected to date, and while our investigation is ongoing, last month we advised the Inspector General that we do not agree with some of the report’s conclusions as to predication and how the FBI case was opened.”

You can, of course, draw your own conclusions.

Like sand through an hourglass.....another USDOJ doc thanks to the FOIA

Revealed: Identity of top FBI official who leaked secret information to media

quote
His identity is contained in a 21-page report obtained through a Freedom of Information Act request. The report reveals that investigators for Department of Justice Inspector General Michael Horowitz determined that Bryan Paarmann, 53, the deputy assistant director of the FBI’s international operations division from 2016 to 2017, “improperly disclosed court-sealed and law enforcement sensitive information to the media” in violation of FBI rules.

The incident is one Horowitz included as part of what his June 2018 report called the FBI’s “culture of unauthorized media contacts.” A one-page summary of the investigation was released last May.

Maybe the "premiere law enforcement agency" needs some of this:

Last Friday was the deadline for the FBI to present to the court their sworn written statement referred to in the second to last paragraph of the document that I posted at the top of this page.

Some of you will be pleased to hear that the "deep state" is alive and well.

FISA court selects former Obama admin lawyer, left-wing blogger to oversee FBI's surveillance reforms

quote
The Foreign Intelligence Surveillance Court (FISC) has stunned court-watchers by selecting David Kris -- a former Obama administration lawyer who has appeared on "The Rachel Maddow Show" and written extensively in support of the FBI's surveillance practices on the left-wing blog Lawfare -- to oversee the FBI's implementation of reforms in the wake of a damning Department of Justice inspector general report last year.

'Ridiculous choice': Obama lawyer David Kris picked to oversee FISA reform oversight

quote
David Kris, a former assistant attorney general with the DOJ’s national security division during the Obama administration, is a controversial choice, having spent most of President Trump’s term defending the bureau’s decision-making, including its use of British ex-spy Christopher Steele’s salacious and unverified dossier to obtain surveillance warrants against former Trump campaign associate Carter Page. Kris also defended the FISA Court itself from accusations it hadn’t done its due diligence to ensure the bureau’s investigation was conducted properly.

Frustrating, to say the least. But, now we have additional insight into why the court approved all of the warrants requested by the FBI.

Here is the FBI plan from Jan 10: https://assets.documentclou...rt-s-Order-Dated.pdf

and

the response by David Kris from Jan 15: https://assets.documentclou...iae-Letter-Brief.pdf

I am given some degree of hope, from the section beginning near the bottom of page 5, which begins, "The FBI's proposed corrective actions are insufficient."

We have something called an SIU. Special investigations Unit. They are supposed to oversee the cops, investigate cop shootings OT brutality, misconduct, eat.

It's staffed with execution-cops, cop wanna-bes, and cop sympathisers and apologists.

You can guess how that works out.

The plot thickens.....

Some interesting stuff here: James Comey focus of FBI leak investigation, report says

quote

The new review, which the Times downplayed as a possibly politically motivated probe, reportedly concerned a Russian intelligence document "claiming a tacit understanding between the Clinton campaign and the [Obama] Justice Department over the inquiry into whether she intentionally revealed classified information through her use of a private email server," as the Post described it in May 2017.

Dutch intelligence accessed the document on Russian computers and provided it to the FBI. Included in the document was a discussion between Rep. Debbie Wasserman Schultz, D-Fla., then the chairwoman of the Democratic National Committee, and Leonard Benardo, who worked with the George Soros-founded group Open Society Foundations.

Schultz told Benardo in the document that then-Attorney General Loretta Lynch would ensure Clinton was not prosecuted in the email probe.

And on opinion piece from the WSJ: The Comey Coverup Unravels

In a curious report on Thursday evening, the New York Times carefully averts its eyes from everything that’s interesting. Even Adam Schiff has acknowledged that James Comey’s actions in 2016 may represent the most important and significant Russian influence on the election.

They are slowly and steadily getting closer to Clinton and Obama.

I want to know why the former UN Ambassador Samantha Power, the former U.S. ambassador to the United Nations, was 'unmasking' at such a rapid pace in the final months of the Obama administration that she averaged more than one request for every working day in 2016 – and even sought information in the days leading up to President Trump’s inauguration.

Requests to identify Americans whose names surfaced in foreign intelligence reporting, known as unmasking, exceeded 260 last year. One source indicated this occurred in the final days of the Obama White House.

You will hear that this latest Comey investigation is about leaks and political retribution. It is not. It is about what is in those documents. They lead through Loretta Lynch to Obama and Clinton, and a cover up. I hinted at this in post #11 of this thread by linking to a thread from shortly after Comey surreptitiously dismissed Clinton's transgressions.

FISA Court Confirms Two Carter Page Surveillance Applications ‘Not Valid’

quote
The order revealed that the government found two of the surveillance application renewals to be “not valid” based on “the material misstatements and omission” used by the FBI, which was found by the Justice Department to have “insufficient predication to establish probable cause to believe that Page was acting as an agent of a foreign power.

Imagine that.

Interesting: https://www.hsgac.senate.go...%20investigation.pdf

quote

We have reviewed the classified report of the Office of the Inspector General (OIG) with regard to the FBI’s Crossfire Hurricane investigation, and we are deeply concerned about certain information that remains classified.

Specifically, we are concerned that certain sections of the public version of the report are misleading because they are contradicted by relevant and probative classified information redacted in four footnotes. This classified information is significant not only because it contradicts key statements in a section of the report, but also because it provides insight essential for an accurate evaluation of the entire investigation.

Johnson and Grassley are asking Barr to declassify some information which would clarify the findings of the investigation. They believe that the American people deserve to know the truth.

Folks, I know it is a slow trickle, but the waters of truth are flowing.

Biggest threat to this country isn't so much the leadership.
That IS an issue, but , this is a bigger one.

The left hate anything the right stands for, and the right hates everything the left stand for. not talking about those in office, I'm talking we the people.
So, people follow whatever their side does just because they know it pisses off the other side. If it make the country better or your local area better (local government issues) don't matter anymore, just that you are sticking it to the other side.
This mindset is a bigger threat to this country and anything else and will be our down fall.
Sadly we are all guilty of this. some more than others.

Willie, responding to a comment from another thread here, because it's more applicable here. Just to caveat, I want to make it clear I'm totally on your side on this... and no one should stop talking about what's going on... but I've genuinely lost any faith that anything will ever happen.

Even though the general public is completely unaware, the Democratic leadership is in panic. They know that if they don't regain power, their day of reckoning will come.

Willie, I'm sorry. For the past 12 years, all I've seen from people like Sean Hannity, all the talking heads, and all Republican supporters, is that "so and so" is going to see justice. In the past 12 years, I have yet to see a single individual, not a single individual that has faced public scrutiny on the Democrat side, actually see a single day of justice. Even Louis Lerner, who was proven guilty to have conspired and participated... to the point where even the IRS and DOJ were required to pay damages to these organizations. Louis didn't see a single day in jail. Not a single Democrat has seen a single day in jail. To that point, I've seen numerous Republicans, or Republican-leaning individuals serve jail time, and have their lives destroyed for things that in most cases aren't illegal, and that all the Democrats are guilty of.

I don't really have any point in writing this, because it's not like I'm suddenly going to vote Democrat, or renounce my citizenship. But I'm being a realist here. Like Fats said... Republicans / Conservatives / most Moderates, and even right-leaning Democrats all are the rule-followers. The Democrats exist on a completely different mindset and concept where by success and winning comes "at any cost" and "by any means."

Again, I've long given up voting for Democrats, and for the past couple of elections, I vote straight-ticket Republican now, and will continue to do so. But I'm just being honest about this. Nothing... I mean absolutely nothing will come of this. Bill Barr seems like a great guy, but not a single thing will happen. Every Democrat will get away with everything, as they always do.

I will not abandon hope. I have seen more progress against institutionalized corruption over the last few years than at any other time in my life. I will keep this thread alive to shine a light into a deep, dark hole in hopes that others will take the time to look in and see the truth.

We need more guys like Trey Gowdy because we have too many guys like James Comey.

The wheels are turning slowly and silently, and that is the way it should be.

Everyone needs to understand that that statement was not made by a reasonable man.

The biggest uphill battle we have is against the "mainstream media", the purveyors of propaganda. They are prestidigitators who have the public in awe as they saw lady liberty in half.

I have hopes that many of the conspirators in the Russian Hoax collusion will come to justice, because of who is on their case. Barr is not one to be trifled with. But, there are so many bad actors within the alphabet agencies that just going after the people involved in the Russian Hoax won't settle anything. The biggest problem we have is that congress has ceded their authority to the bureaucracy. In stead of congress being the only ones making laws we have bureaucrats making rules with the force of law. We can vote the congressmen out every two years if we want and senators out every 6 years. But, it is almost impossible to remove a bureaucrat. So these self righteous elitists remain in power no matter who we elect to congress and to the presidency. Louis Lerner is a prime example of how hard it is to get rid of these bureaucrats or to punish them for the crimes they commit.

Keeping Donald Trump in office is key to getting some of the worse most egregious abuses eliminated. But, it is going to take decades to right the ship of state. And we as a country don't have a clear consensus that this needs to be done. All we can do as citizens and voters is to do our best to put people into office with a commitment to cleaning up the mess. But, it takes an extraordinary individual to put their own self interests aside to better the country.

Louis Lerner didn't get charged, because everyone pretty much knows it was directed by President Obama. But that's the problem... the FBI refused to prosecute, because they knew.

I understand what you're saying. A Trump win or not... we will not see a single Democrat go to jail. I absolutely guarantee that to you, and we can go back to this post 4 years from now when we're talking about 2024.

Carter Page has filed suit against the DNC and Perkins Coie: https://www.courtlistener.c....ilnd.373050.1.0.pdf

quote
The Defendants are private actors who used false information, misrepresentations
and other misconduct to direct the power of the international intelligence apparatus and the media
industry against a private individual, Plaintiff Carter Page, to further their political agenda.
